i) Participant(s) must be citizens of India, and of eighteen (18) years of age or above and must be residing in India at the start date of the Contest Period. The Participant(s) should not have criminal conviction or an arrangement or a contract that prevents the Participant(s) from participating in the Contest.

ii) Employees of and/or consultants of and/or persons hired on contract by Star India and/or Brand Partner, and the members of their immediate family are ineligible from participating in the Contest.

iii) Each Participant shall be permitted to send/upload only 1(one) Entry. The Participant(s) agree and confirm that the entire contents of their Entry, including without limitation, the User Information, recipe and photographs shall be their own, and the Participant shall at no time furnish any data/information or image which belongs to any third party.

iv) The Participant(s) specifically confirm that the recipe and the photograph furnished by them are their original works, and in no manner whatsoever, violate any third-party rights, including any intellectual property rights, trade secrets, confidentiality obligations etc.

v) It shall be the Participants’ responsibility to ensure that the User Information is accurate and Star India and/or Brand Partner shall have the right to take recourse to any legal action or remedy available under law in the event of any inaccurate or false User Information being furnished by the Participant(s).

vi) Out of all the Entries received, Entries of 15 (fifteen) Participants shall be shortlisted on the basis of various parameters, including without limitation, creativity, presentation and how well the recipe pairs will Society Tea (“Shortlisted Participants”).

vii) All the Shortlisted Participants shall be contacted on the mobile number provided as part of their Entries and be called for further interviews/auditions, which shall be held at such place and time as determined by Star India and/or Brand Partner, at their sole discretion.

ix) The Participants hereby agree and acknowledge that the shortlisting or selection as Winner of the Participants shall subject to the fulfilment of all of the requirements set out in these Terms and Conditions. The Shortlisted Participant(s) may be required by Star India and/or Brand Partner to submit copies of their identity proof/age proof (“Document”) via such means and in such duration as maybe communicated by Star India and/or Brand Partner, at its sole discretion. In the event, any Shortlisted Participant(s) fails to submit the Documents, his/her participation maybe be invalidated and Star India and/or Brand Partner may, at its sole discretion, forfeit his/her chance to win the Prize (as defined below). Further, the Participant(s) hereby agree and acknowledge that Star India and/or Brand Partner reserves the right to disqualify and/or cancel any Entry at any point of time, at its sole discretion and without assigning any reason whatsoever, without any protest or demur from the Participant.

x) With respect to any communication to be made for the purpose of this Contest, the Participants agree and acknowledge that Star India and/or Brand Partner shall make only one (1) attempt to reach the Shortlisted Participant(s). In case they do not revert, their selection shall be invalidated and Star India and/or Brand Partner shall not be liable to that Participant(s) in any manner whatsoever.

xi) The Participants agree that Star India and/or Brand Partner reserves the right to change the number of Shortlisted Participants and/or the number of Winners, at its sole discretion and without any protest or demur from the Participants. It is clarified that Star India and/or Brand Partner shall not be obligated to shortlist another Participant(s) in place of any forfeited/disqualified Participant(s).

xii) The decision of Star India and/or Brand Partner is final and binding in this regard and the Participant shall not challenge the same in any manner whatsoever. Further, Star India and/or Brand Partner shall be under no obligation whatsoever to share or disclose, inter-alia, any methodology/parameters used to shortlist the Participants or select the Winners.

xiii) Winners of the Contest shall have chance to win the following (“Prize”):

xiv) In this regard, the Participants hereby agree that the Participant(s) shall be required to reach the audition/interview/Shoot venue at their own cost, and Star India and/or Brand Partner shall not be responsible for any travel, boarding, lodging or any risks/liabilities associated with reaching the venue. Furthermore, the Participants hereby agree that audition/interview /Shoot venue and/or time maybe changed by Star India at its sole discretion, without any notice to the Participants. In the event any Shortlisted Participant(s) and/or Winner fails to reach the correct audition/interview/Shoot venue at the assigned time, Star India reserves the right to disqualify such Participant, without any further liability to him/her.

xv) Participants shall strictly comply with safety protocols as mentioned herein and as communicated by Star India and/or Brand Partner from time to time. Adherence to the rules shall be a strict condition precedent to the Winners availing the Prize and Shortlisted Participant participating in any audition/interview. Notwithstanding anything contained herein, Star India and/or Brand Partner takes no responsibility to bear or reimburse any cost or expense that may be incurred by the any Participant in relation to the Contest.

xvi) It is hereby expressly stated that the Star India and/or Brand Partner shall not be responsible to bear or reimburse any costs and expenses incurred by the Participants availing the said Prize and/or participating in audition/interview/Shoot or otherwise incurred otherwise including but not limited to the travel, ground transportation / internal travel, accommodation, food, beverages etc. It is hereby expressly stated that the Participants shall be solely responsible to arrange and pay for all costs/expenses incurred by the Participants in availing the said Prize and/or participating in interview/auditions/Shoot and/or incurred otherwise.

xvii) All decisions of Star India and/or Brand Partner shall not be subject to any appeal of any nature whatsoever. By participating in the Contest, it shall be construed that the Participant has waived his/her right to dispute Contest and/or the Prize and/or any decision(s) made by Star India and/or Brand Partner.

xviii) Each Participant consents to the use all the contents of their Entries, including User Information, photograph and recipes to the extent possible under any applicable laws of India, in any media for further promotional, marketing and publicity purposes without any further payment or other compensation to the Participant by Star India and/or Brand Partner and its affiliates.

xix) The Participants shall not in any circumstances make any claims against Star India and/or Brand Partner or Star India’s and/or Brand Partner’s affiliates/entities/representatives arising out of or relating to any and all costs, injuries, losses or damages of any kind, including, without limitation due to any technical faults or directly or indirectly, to the winner’s participation or non-participation in the Contest or any related activity. If any Participant is found to be ineligible, or if he or she has not complied with these terms and conditions, their participation will not be considered further.

xx) If Star India and/or Brand Partner so elects, the Participants may be required to submit to a confidential background check to confirm eligibility and may even be required to sign a release letter on the format provided by Star India and/or Brand Partner and help ensure that the Participant(s) will not bring Star India and/or Brand Partner entities into public disrepute, contempt, scandal or ridicule or reflect unfavorably on Star India and/or Brand Partner as determined in their sole discretion.

xxi) Star India and/or Brand Partner reserves the right to change the Prize at any time at its discretion.

xxii) The Prize cannot be transferred, negotiated, refunded or exchanged and only the Winner(s), and not any other person or agent, may claim the Prize.

xxiii) The Participants acknowledge and agree that the product /item being distributed as Prize is manufactured by the original manufacturer and Star India and/or Brand Partner does not give any guarantee and/or warranty with respect to the product /item being distributed as Prize. The Participant agrees that Star India and/or Brand Partner holds no responsibility if the prize /any other product/item provided as Prize for Prize Winner is damaged or defective in any manner. Star India and/or Brand Partner, its affiliates, agents/representatives do not give any guarantee/warranty with respect to the products/items being offered as prize. The products / items to be given as Prize will be provided on an ‘as is’ basis. The Participant acknowledges and agrees that the respective merchant (who owns/manufactures the products) is responsible for its products provided as Prize. Star India and/or Brand Partner, its affiliates, agents/representatives shall not be liable or responsible for any defect and/or deficiency in the products being provided as Prize, at any time whatsoever. Star India and/or Brand Partner shall engage a third party (‘Star India’s agent/representative) who shall be delivering / dispatching the various products / items being provided as Prize to the Winners. Star India and/or Brand Partner and/or its affiliates / agents/representatives / partners are not under any obligation whatsoever to either replace the product with a similar product or any other product as Prize/gratification.

xxiv) the Participants shall not raise any objection /claims of any nature whatsoever against Star India and/or Brand Partner at any time in event of any damage caused to the products /items (being provided as Prize), while in transit and/or in event any product / item provided as Prize is defective in any manner and/or otherwise. The Participant shall not claim any refund with respect to any product / item provided as Prize in event of any damage/ defect of any nature whatsoever. The Participants agree and acknowledge that Star India and/or Brand Partner shall not be responsible and/or liable for the quality / condition/utility / usability, etc. of the products/ items provided as Prize. Star India and/or Brand Partner and/or its affiliates / agents/representatives / partners /sponsors shall not be liable for any damage caused to any Participant /user of the product upon use of the product provided as Prize at any time whatsoever.

xxv) Income tax, gift tax or any other statutory taxes, duties or levies as may be applicable from time-to-time, arising out of Prize, if any, shall be borne and paid by the respective Winners and no monies will be reimbursed by Star India and/or Brand Partner at any time whatsoever. In case the Winners fail to comply with the applicable laws or pay the requisite taxes, duties or levies, if any, such Winners shall indemnify Star India and/or Brand Partner of any losses, claims, expenses, costs and actions for the same.

xxvi) The Participant agrees to indemnify and hold Star India and/or Brand Partner, its affiliates, their directors, officers, employees, agents, partners, representatives, contractors, sponsors, and licensors/licensees harmless with respect to any claims arising out of Participant’s breach of any of these Terms and Conditions or arising out of the Participant’s participation in the Contest in any manner whatsoever. The Participants agree that he / she cannot sue or recover any damages from Star India and/or Brand Partner and/ or any of its directors, officers, employees, affiliates, agents, contractors, partners, representatives, and licensors/licensees as a result of Star India and/or Brand Partner’s decision to remove or refuse to process any Prize /prize. In the event of any claim arising out of the Participant’s participation in the Contest, the Participant will promptly adjust, settle, defend or otherwise dispose of such claim at its sole cost. If the Participant is not diligently and continuously pursuing this matter, Star India and/or Brand Partner may take such action on behalf of itself and/ or as attorney for the Participant, to adjust, settle, defend or otherwise dispose of such claim, in which case the Participant shall, reimburse Star India and/or Brand Partner for any costs and penalties incurred thereof or such other indemnity in the amount thereof.

xxvii) Limitations of Lability: By entering the Contest, each Participant acknowledges and agrees that: (i) any and all disputes, claims and causes of action arising out of or in connection with the Contest, or any Prize awarded, shall be resolved individually, without resort to any form of class action; and (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred and associated with entering the contest (if any), notwithstanding the foregoing, under no circumstances will Star India and/or Brand Partner and/or Star India’s and/or Brand Partner’s entities be liable for any consequential, indirect, special punitive, or incidental damages or lost profits, whether direct or indirect, arising in any way whether in contract, tort (including negligence) or otherwise.

xxviii) Participation shall be governed by the terms and conditions as detailed hereinafter. Upon registering to participating in the Contest on the registration page, the Participant hereby agrees to have read and understood all the terms and conditions stated herein and agrees to abide by the same.
